1. Acceptance of Terms

By accessing or using our Service (available at ratethislist.com, listarater.com, and rankselect.com, collectively "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service. The Service is a web application that allows users to create, manage, and rank lists of items using a pairwise comparison method and an Elo-based algorithm.

2. Description of Service

The Service includes features for user authentication (including guest access), list creation, item ranking, and for premium users, additional features such as AI-powered analysis and CSV export.

3. User Accounts

To access most features of the Service, you must register for an account. You can register using an email and password, a Google account, or by using a temporary guest account. You are responsible for safeguarding your account information and for all activities that occur under your account.

4. User Content

You retain ownership of any content you create on the Service, such as the titles, descriptions, and items in your lists ("User Content"). By creating User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content in connection with providing the Service.

5. Acceptable Use

You agree not to use the Service for any unlawful purpose or to engage in any activity that is harmful, threatening, or otherwise objectionable. You will not attempt to disrupt the Service or access it using a method other than the interface and instructions that we provide.

6. Premium Services

We offer a premium subscription for $5/month that provides access to additional features, such as AI-Powered Analysis and CSV Export. A 5-day free trial is available for the premium subscription. Fees for premium services are billed on a subscription basis and will automatically renew unless canceled.

7. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS IS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9. Limitation of Liability

In no event shall we or our suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service, even if we or an authorized representative has been notified orally or in writing of the possibility of such damage.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
